#### Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Environment Policy 7

#### Assessment

The application is seeking permission for the retention of a landing stage, which abut the River Douglas.

The Manx River Improvement Association have commented that the landing stage would have involved considerable disturbance to the River Bank, and, in all probability, the deposition of

deleterious matter in the form of cement and silt into the River. The construction would appear to have taken place with no regard to Planning and or concern for the environment.

The Land Drainage Section of the Department of Transport has no objection to the proposal and has already issued a consent under Section 5 of the Land Drainage Act in respect of this proposal.

The Inland Fisheries section of the Department of Agriculture, Fisheries and Forestry have seen the structure when it was first installed (or being installed) and they are comfortable that there will be no long term adverse effect on the aquatic or bankside habitat. They have also indicated that during the construction the area was bunded off to install the footings, and there was no risk of pollution to the river.

In terms of the visual impact of the landing stage within the locality, the landing stage is not readily visible from any major public thoroughfares and therefore the retention of the landing stage would not adversely affect the visual amenities of the locality.

I therefore recommend that planning permission be granted.

## **PARTY STATUS**

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Inland Fisheries of the Department of Agriculture, Fisheries and Forestry have commented on planning matters and as such should be afforded party status.

The Manx River Improvement Association does not have sufficient interest in the application and therefore should not be afforded party status in this instance.
