In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

which was considered on 17th September 2009, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This approval relates to the erection of a building to provide retail and office space and six residential apartments with associated parking as proposed in the submitted documents and drawings $1540 / 06-01 \mathrm{~A}, 1540 / 06-50 \mathrm{C}, 1540 / 06-100 \mathrm{C}, 1540 / 06-101 \mathrm{C}, 1540 / 06-102 \mathrm{C}$, $1540 / 06-103 \mathrm{C}, 1540 / 06-104 \mathrm{C}$ and $1540 / 06-40-42$ all received on 2nd June 2009.
3. Prior to their use within the development, there must be submitted to and approved in writing by the Planning Authority, samples of the external finishes of the building. The building shall not be finished externally except in accordance with the details so approved.

4. No development may commence on site until the Planning Authority has agreed in writing a method statement for the construction of the proposed development. Such method statement should include details of the hours of operation, the construction traffic and parking arrangements and the operation of any building compound. Development shall not proceed except in accordance with the method statement so agreed.
5. Prior to the occupation of any part of the building, the accesses onto West Quay and Auckland Lane are to be completed to the required standard of the Department of Transport Highway Division and all the hard standing to the rear of the building is to be completed to allow the required parking provisions to be used. The parking spaces shall not be used other than for car parking.
6. Prior to the commencement of any works, there must be submitted to and approved by the Planning Authority a proposed scheme indicating flood prevention measures which would be implemented in the event of flooding of the area.
7. Notwithstanding the submitted plan, a further plan of a revised parking layout shall be submitted to and approved in writing by the Planning Authority prior to the commencement of any works. The plan shall include:
Disabled person's parking provision; and
The bin storage area relocated adjacent to Auckland Lane, in a position to be agreed in consultation with Ramsey Commissioners.

NOTE Any proposals for external signage must form the subject of a separate application under the Advertisement Regulations.

NOTE Prior to the commencement of any works the applicant is asked that a Photographic survey be undertaken of the "Belfast Trusses" within the warehouse on the corner of West Quay and Christian Street and submitted for permanent record to the Planning Authority.

NOTE Whilst the application proposes only six residential units and therefore does not require the provision of affordable units in accordance with Housing Policy 5, if at any time additional units are proposed either through the subdivision of the approved units, the conversion of retail or office units or the construction of further units within the site, the cumulative amount of units will be considered, over and above what is hereby approved and if the total number of units on the site exceeds 7 , affordable housing will be required in accordance with Housing Policy 5 .

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

## Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;

Whichever is the later.
