### Officer's Report

### The Site

The application site comprises the residential curtilage of 24 Castle Street in Peel which is a two storey detached cottage.

### The Proposal

The proposed application seeks approval for the replacement of the front and back doors with painted hardwood "stable like" doors and the replacement of the existing windows to the front and rear elevations with timber sliding sash.

The dwelling would be re-rendered to match the existing and the roof would be fitted with natural slate, together with two Velux rooflights installed to the rear elevation of the property. The north western chimney stack would be reduced in height to match the original.

### Planning Status

In terms of local plan policy, the application site is located within an area designated as being "Mixed Use" and within the "Conservation Area" under the Peel Local Plan, 1989. There is a policy within the Peel Written Statement (Planning Circular 6/89), which is considered specifically material to the assessment of this current planning application - Policy 9.16 states:

"Particular attention will be paid to the alteration or extension of a building within the Conservation Area which must be carried out in a manner sympathetic to the existing building and its setting".

The Isle of Man Strategic Plan 2007 contains two policies which are considered specifically material to the assessment of this current planning application - General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;
- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption."

Environment Policy 35 states:
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development".

## Planning History

Whilst the application site has been the subject of previous planning applications it is considered that none of these are specifically relevant to the assessment of the current planning application.

### Representations

The Peel Town Commissioners have approved the proposed development. The Department of Transport Highways Division have not commented on the proposal.

### Assessment / Recommendation

It is considered that the proposed alterations would be acceptable as it respects the application site and surroundings in terms of the form and design. The replacement windows, doors and slate roof, together with the re-rendering of the dwelling, are all collectively regarded as improvements which respect the Conservation Area in which it is situated. As such, the proposed alterations would be inkeeping with the character of the existing property and the surrounding area, which would be

sympathetic to its setting and would ensure that the special features contributing to the character of the Conservation Area are preserved.

It is judged that the proposed development would comply with Planning Circular 6/89 - Policy 9.16 and Environment Policy 35 and General Policy 2 of Isle of Man Strategic Plan 2007 and it is recommended that this planning application should be permitted.
