### Officer's Report

### The Site

The site defined in red represents the footprint of an existing building situated fronting onto of Bay View Road between Gellings Avenue and Victoria Road. The building is used as a shop on the ground floor (a pharmacy) with flats above on the upper two floors. The ground floor has a modern shopfront within it and the upper floors are fitted with white plastic framed casement windows. The windows in the properties alongside are plastic framed casements. The windows in the first floor of the applicant property are presently timber framed.

### Planning Status

THE site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Shopping.

### Planning History

OF relevance in the planning history of this building is the approval granted for the replacement of windows in the rear - PA 00/2140 and the shopfront earlier in 1987.

### The Proposal

The application proposes the installation of replacement windows in white plastic frames to match the windows already in the building and in other properties in the terrace.

Port St. Mary Commissioners raise no objection to the application.

## ASSESSMENT

The proposal should be assessed in the context of General Policy 2 which requires, inter alia that development should respect the character and appearance of the property and the surrounding area. In this case the existing building has a majority of its windows already replaced in accordance with the proposed style and material of frame and the area in general is not within a Conservation Area and has a majority of plastic framed windows with a variety of colours and opening styles.

As such the proposal is considered acceptable.

## PARTY STATUS

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
