### Officer's Report

#### The Site

The site defined in red represents a strip of land approximately 40m wide and 180m long lying alongside the land which has approval for the development of a mixed residential scheme, to the south of Derby/Poortown Road (A20). The application site does not extend all the way to the A20 but stops 8 or 9m short of it: similarly the site also stops short of the treed farm lane running east from the former Ballawattleworth Farm buildings. The site is part of part of a larger open field which is relatively flat.

#### The Proposal

This application seeks retrospective planning approval for the temporary storage of construction materials from the adjacent housing development. It is stated within the application form that as the residential scheme (Reayrt Ny Keylley) enters its final stages and temporary on-site storage areas are developed with housing alternative storage arrangements are required. It is stated that the storage of

construction materials will be temporary pending the completion of the adjoining development and subject to the granting of planning approval for PA09/00521/B, commencement of work on the subsequent phase. A period of 2 years is proposed.

A recent site visit ascertained that the level of storage on the site has reduced significantly since the submission of this application in line with the development of Reayrt Ny Keylley reaching its final stages.

## **PLANNING STATUS**

The application site is located within an area identified as being Predominantly Residential use by the Peel Local Plan (Planning Circular 6/89). The site had until the introduction of stored soil and construction materials been used for agriculture.

**PLANNING HISTORY** The following previous planning applications are considered relevant in the assessment and determination of this application: 07/02224/B sought temporary approval for the storage of soil from housing development site. This was approved with the following conditions:

C1. "This permission relates to the storage of soil taken from the development site immediately to the west, for a temporary period of two years which will expire on 30th November, 2009 (which is two years from the date of submission) or until such times as the residential development is completed, whichever is the sooner. Upon completion of the development or at the expiry of two years as above all deposited soil must be removed from the site, the temporary fencing removed and the site used in conjunction with the remainder of field 315097 as Open Space /Agriculture."

C2. "The soil may be stored at a height not exceeding 6.5m above original ground level."

**REPRESENTATIONS**

The owners/occupiers of Sea Peep, Poortown Road, Peel object to this application on the grounds that the storage of materials is an eyesore. Comments are made regarding the enforcement process. It should be noted that where breaches of planning control occur, the first step is to allow the applicant to submit an application in order for the Planning Authority to assess and make decision as to whether the development is acceptable. If it is resolved that planning permission should not be granted, enforcement action can then be initiated. The lack of a waste disposal licence is also raised.

The Department of Transport Highways Division does not oppose this application.

Peel Town Commissioners object to this application stating that Peel has been developed sufficiently and any further housing development would adversely impact the Town's infrastructure.

**ASSESSMENT**

The assessment of this application must be carried out having regard to current planning application 09/00521/B which seeks approval for residential development on the site and is recommended for approval. If the Planning Committee is minded to accept the recommendation to approve 09/00521/B, it would follow that the temporary storage of construction materials on the site would be a reasonable part of the approved development.

If however the Planning Committee decides to refuse 09/00521/B, this application should either be refused and enforcement action initiated or a temporary approval along the lines of that granted for 07/02224/B should be issued requiring by condition the removal of all materials by 30th November, 2009.

This approval relates to the temporary storage of construction materials from housing development site, part Field 315097, Peel as shown by 2197 APL 100 F and 2197 APL 134 C received 19th May 2009.

C 2. This permission is for a temporary period of 2 years after which all materials shall be removed from the site unless planning approval is given for an alternative development.
