### Officer's Report

### Site

The application site comprises of the residential curtilage of No. 10 Sartfell Road, Douglas. The site is zoned as predominantly residential within the Douglas Local Plan 1998. The application site is located within a Conservation Area.

### Proposed Development

The application is seeking planning permission for a solar panel, which will have an overall area of 2 square metre.

### Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Environment Policy 35.

Environment Policy 35 states that "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the area, and will ensure that he special features contributing to the character and quality are protected against inappropriate development."

Section 18 (4) of the Town and Country Planning Act 1999 states that "Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or

enhancing it character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act."

PLANNING HISTORY There have been no previous planning applications considered relevant to the assessment of this application.

REPRESENTATIONS Douglas Corporation does not oppose the application.

ASSESSMENT The application submitted is very poor in that no scaled drawings of the proposed solar panel have been submitted to accurately show the precise detailing of the solar panel in relation to the property. The application only shows a photomontage, which does not accurately depict the solar panel. Furthermore, the applicant has indicated that the photomontage is only showing an approximate position of the solar panel on the roof, as the installer's have said it is impossible to be exact with the positioning as this may alter slightly depending on where the roof supports are situated.

However, the proposed solar panel is to be located to the rear of the property and will not be readily visible from a public thoroughfare. It is considered that appropriate conditions can be attached to ensure the impact of the development is minimised. I therefore recommend that planning permission be granted subject to conditions.

RECOMMENDATION It is recommended that the planning permission be granted subject to conditions.

PARTY STATUS The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
