### Officer's Report

#### The Site

The application site represents the curtilage of 35 Douglas Street, Peel, an end terrace double fronted cottage situated on the north eastern side of the road. The property abuts the kerb at the front and has a rear yard enclosed by high boundary walls.

#### The Proposal

This application seeks approval for the demolition of existing outbuildings (consisting of a lean to kitchen, an outside wc and store), the creation of a rear gate and the replacement of a door to the rear with a window. The proposed works are contained within the rear yard of the property and as such would not be appreciated from public vantage points. The structures to be removed are of poor form as illustrated by the submitted photographs. The removal of the structure identified as "add on store" would reveal a doorway. It is proposed to replace this door with a vertically proportioned window. A pedestrian access gate would be installed into the rear yard boundary wall.

#### Planning Status

The application site is located within an area identified as being mixed use by the Peel Local Plan. The site is within the Peel Conservation Area and as such Environmental Policy 35 of the Strategic Plan is relevant. This states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

## Planning History

The following previous planning applications are considered relevant in the assessment and determination of this application:

06/01540/B sought approval for the installation of uPVC casement windows to replace existing. This was refused. 06/02182/B sought approval for the installation of uPVC sliding sash windows and door to front elevation and uPVC casement windows to rear. This was permitted.

### Representations

The Department of Transport Highways Division do not object to this application. Peel Town Commissioners do not object to this application.

### Assessment

The main issue to be considered in the assessment and determination of this application is whether the proposed works would preserve or enhance the character of the Peel Conservation Area.

The proposed development is contained within the rear yard of the property and as such views of the works would not be available from the public thoroughfare of Douglas Street. Notwithstanding this, the removal of the outbuildings which are of poor form an in a dilapidated condition would represent an improvement over the existing situation.

The installation of a window in place of the door way at first floor level is considered to be acceptable and would not adversely affect the existing dwelling and the installation of a pedestrian access gate from the yard to the side passage is also considered to be an unobjectionable alteration.

It is judged that the proposed development would preserve the character of the Peel Conservation Area in accordance with Environmental Policy 35.

### C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

### C 2.

This approval relates to the demolition of existing outbuildings to rear elevation, creation of rear entrance gate and the replacement of a rear door with a window, Douglas Street, Peel as shown by the Location Plan, Site Plan and Photographs all received 1st April 2009.

### C 3.

The rear entrance gate must on creation be fitted with a solid timber door and retained as such thereafter.
