### Officer's Report

### The Site

The site represents the curtilage of an existing residential property situated on the eastern side of Malew Street, to the north of its junction with The Crofts. The property is a terraced property with sliding sash windows and traditional front door. At the rear there is a large full width annex with sunken garden area and where the windows are casement style.

### Planning Status

The site lies within Castletown's Conservation Area and within an area of Residential use on the Castletown Local and draft Area Plans.

### Planning History

The following applications have been considered in respect of this property:
PA 07/0679- alterations and erection of extensions to rear - permitted
PA 07/1792 - alterations and installation of replacement windows and doors - refused
PA 08/0872 - erection of wall, steps and fence - permitted

### The Proposal

Now proposed is the installation of a satellite dish which will be black or slate grey and 44 cm diameter. No specific location has been identified on the submitted photograph but an indication that it could be erected on the wall or the chimney stack.

### Assessment

As the property lies within a Conservation Area, there is a requirement to preserve or enhance the appearance and character of the property and the Area, under the provisions of Conservation Policy 35 and Planning Policy Statement 1/01. In this case, the proposal is for the installation of a modest dark coloured satellite dish which would not affect the fabric of the building and could be removed at any time in the future. If attached to the chimney stack this would not appear as something unexpected or unacceptable and would be considered acceptable, despite not enhancing the appearance or character of the property. However, if attached to the front wall of the property, this would be an incongruous and very visible feature which would not be acceptable as it would detract significantly from the appearance of the property. It would also be likely to protrude into the street which is unlikely to be acceptable.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the installation of a black or grey 44 cm satellite dish attached to the chimney stack as shown in the photograph submitted with the application and received on 9th March, 2009.

No approval is granted to the installation of the dish on any part of the front wall of the property as this would be an incongruous and prominent feature on an otherwise traditionally styled and detailed building within Castletown's Conservation Area.

C 3. No advertising matter may be displayed upon the dish.
