In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the application made by you on behalf of: Fort Island Limited

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

SCHEDULE OF CONDITIONS

Application Ref No: 02/02553/A On Review

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

2. This approval relates to the plans and information submitted as part of this application, date stamped 26th March 2003, 4th October 2003, Ref: B/01A; B/02; B/03; B/04; B/05.

3. No water or contaminates from the site shall be permitted to flow or be tracked by vehicle wheels onto the highway.

4. The proposed dwelling may not exceed 8,500 sq feet (measured externally).

5. The Manx Museum and National Trust must be informed of the date when building work is to commence and be given access at all reasonable times, and reasonable opportunity to inspect the site, observe all excavations and investigate any archaeological features exposed.

6. The proposed development site partially includes, and is adjacent to an Area of Special Scientific Interest, designated by the Wildlife Act 1990. Detailed plans should include adequate measures to protect the Area of Special Scientific Interest to the satisfaction of the Planning Authority, following consultation with the Wildlife and Conservation Section, of the Department of Agriculture, Fisheries and Forestry prior to the submission of an application for reserved matters.

NOTE The applicant is advised to consult with the planning officer prior to the submission of a detailed application with specific regard to the siting and landscaping of the dwelling and the siting and design of the proposed gate house.

NOTE For the avoidance of doubt, no approval is hereby granted or implied for the temporary access road.

NOTE Additionally, consent must be sought from the Department of Agriculture, Fisheries and Forestry for any operations that are potentially damaging to the Area of Special Scientific Interest listed in Appendix II of the designation document.
