**C Kniveton Ltd** **Old Turkeyland Quarry – Temporary Operation of Asphalt Plant** **Planning Application for Variation of Condition 2 of Planning Permission 08/01042/B**

On behalf of our clients, C Kniveton Ltd. please find attached a planning application for the Variation of Condition 2 of Planning Permission 08/01042/B.

The variation relates to a change in the permitted timescales to allow the temporary storage of the asphalt plant, prior to its relocation, and its operation to provide promontory surfacing materials.

As this letter effectively provides a supporting statement for the application I have attached four copies.

**Background to the Variation**

Planning permission [Ref: 08/01042/B] was granted to C. Kniveton Ltd for the installation and temporary operation of an asphalt plant at Old Turkeyland Quarry on 18th August 2008. The temporary permission ran to 31st December 2008, the operation of the plant being specifically for the production of asphalt for use in the construction of the Ronaldsway Airport Runway End Safety Area [the Department of Transport's RESA project]. Operations in respect of the RESA project require to be undertaken overnight, to allow the airport to function normally throughout the day.

When the planning application for the asphalt plant was submitted the DoT's development programme for the RESA project had anticipated the completion of asphalt related operations comfortably within the timescale of the Old Turkeyland permission. Unfortunately the development programme had not made provision for the advance booking of the barges required to deliver the armour stone to be used to construct the promontory. This has resulted in a delay in operations which has been wholly outwith C. Kniveton Ltd's control and, whilst some works were undertaken, there is still a requirement for the provision of surfacing materials for the promontory runway end safety areas.

## Duration of Variation

It is anticipated that the surfacing works for the RESA project may now be undertaken at any time from June 2009 to early 2010, the period of works being estimated at a maximum cumulative period of 3 months.

Accordingly, in terms of Paragraph 10[3] of the Town and Country Planning Act 1999, planning permission is sought to vary Condition 2 of Planning Permission 08/01042/B to allow the nonoperational retention of the asphalt plant on-site until June 2010 and resumed utilisation of the plant for up to 3 months during that period, in accordance with Condition 3, and thereafter decommissioning in accordance with Condition 5. As the DoT are unable to provide specific dates for the operational periods it is proposed that the variation shall require the operators to give prior written notification to the Planning Authority of the proposed operational periods.

In all other aspects the plant shall operate in accordance with the details supplied for the original temporary consent.
