In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This approval relates to the submitted drawing 330 received on 19th March, 2009.
3. The rating level of the noise emitted from the car park ventilation system at the Spectrum Apartments shall not exceed LAeq, 1 hour 48 dB daytime ( $0700-2300 \mathrm{hrs}$ ) and LAeq, 5

min 43 dB night-time ( $2300-0700$ hrs) when measured at the façade of any noise sensitive premises.

Note: The measures shall be made according to BS 4142:1997.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

## Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
