### Officer's Report

#### The Site

The application site represents 5 Michael Street, Peel, an existing shop unit situated on the northern side of the road. The property has a central door way with bay windows either side separated by smooth rendered columns. There is a flat roof single storey section of the shop to the western side of the building which has a further bay window. Above the door and windows is the shop signage. The upper floor has retained its vertically proportioned windows although these are fitted with timber casement window frames.

#### The Proposal

This application seeks approval for the installation of replacement uPVC windows and doors to the ground floor front elevation and the installation of uPVC sliding sash windows to the first floor. The details submitted demonstrate the appearance of the proposed replacement windows. The windows proposed at ground floor level would replicate the proportions and glazing bar pattern of the existing windows. The doors would be replaced with replica uPVC doors. All doors and windows would have externally mounted glazing bars.

## Planning Status

The application site is located within an area identified as being Mixed use by the Peel Local Plan. The site is also within the Peel Conservation Area. Within the Isle of Man Strategic Plan 2007, the following policy is considered to be relevant:

### Environmental Policy 35, which states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

There are no previous planning applications considered specifically relevant in the assessment and determination of this application.

## Representations

- Peel Town Commissioners recommend that this application be approved.
- The Department of Transport Highways Division does not oppose this application.

## Assessment

The main issues to be considered in the assessment of this application are whether the proposed replacement windows and door would preserve or enhance the character or appearance of the Conservation Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development, as required by Environmental Policy 35.

The existing windows are most likely not original to the building. The planning database does not show any previous approvals for the existing windows and it is likely that these pre-date the Conservation Area Designation. It is judged that in order for the replacement windows at ground floor level to either preserve or enhance the area, they would be required to replicate the style and appearance of the existing windows which are considered to be attractive features of the building. The submitted drawings show that the proposed windows would replicate the existing and would retain the bow (see drawing 09/00182/9). The upper windows are not original having casement opening and the proposed sliding sash windows would represent an improvement.

It is judged that as the proposed windows and doors at ground floor level would replicate the existing windows they are acceptable. The windows at first floor level would reinstate the original method of opening and as such the proposed development is considered to be acceptable.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the installation of replacement windows and doors to the front elevation of 5 Michael Street, Peel as shown by the information and plans 00182/1, 00182/2, 00182/3 and Photograph Sheet all received 9th February 2009 and 09/00182/5, 09/00182/6, 09/00182/7, 09/00182/8, 09/00182/9 and 09/00182/10 all received 24th July 2009.

C 3. The approved windows and doors shall be constructed with externally fitted glazing bars which must be retained as such thereafter.

C 4. The first floor windows must be sliding sash in accordance with submitted drawing 09/00182/8.
