### Officer's Report

#### The Site

The application site is the curtilage of the detached dwelling Marown Court, Main Road, Glen Vine. The property is situated on the southern side of the road. To the immediate east of the dwelling is a detached garage which due to the topography of the site has a lower ground floor that is accessible from the rear.

#### The Proposal

This application seeks approval for the use of the ground floor of the detached garage as a granny flat/tourist accommodation. The accommodation provided by the garage would include a living room with open plan kitchen area and a bedroom with en-suite bathroom. The application originally stated that the proposal was for the additional use of granny flat as tourist accommodation. However after checking the planning history for the site it became apparent that no approval has been granted for the use of the ground floor of the garage as a granny flat. As such this is a partly retrospective proposal.

The application site is located within an area identified as being residential use by the 1982 Development Order.

## Planning History

The following previous planning applications are considered relevant in the assessment and determination of this application:

05/00286/B Amendments to approved dwelling. Permitted. 04/00117/B Erection of dwelling with detached garage. Permitted.

## Representations

Marown Parish Commissioners do not object to this application.

The Highways Division of the Department of Infrastructure does not object to this application.

The Environmental Health Officer of the Department of Environment, Food and Agriculture has provided information to the applicant regarding the Housing (Flats) Regulations 1982.

## Assessment

The main issues to be considered in the assessment of this application are the impact of the proposal upon the amenity of the surrounding area and impact upon private amenity.

The proposed accommodation would be self-contained, having all of the facilities of a small dwelling. However it is proposed that the accommodation would remain part of the curtilage of Marown Court as opposed to a separate planning unit. It is however necessary to consider the potential for subdivision of the site to form two separate dwellings as this would have potential adverse impacts. In this case, the site is served by a single access and the garage building is located in very close proximity to the main dwelling on the opposite side of the site from the access. This would act to inhibit future subdivision. Furthermore the accommodation is within the garage building which serves Marown Court which is a large dwelling that would likely require the garage to remain at its service.

It is concluded that this is unlikely to be future pressure to subdivide the plot as a result of this application being permitted.

In terms of impact upon private amenity, Marown Park is the only one other dwelling situated close to the proposal site (to the east of the garage building). There is a substantial distance between the site and Marown Park and it is judged that there would not be any unacceptable impacts upon private amenity as a result of the proposed development.

The proposed tourist use of the lower ground floor of the garage would likely result in a rise in vehicle movements to and from the site. However the Highways Division has confirmed that it does not oppose the development as it would not have any unacceptable adverse highway safety impacts.

## Recommendation

Permit.

## Party Status

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Accordingly the following parties are not granted Interested Party Status:

The Environmental Health Officer of the Department of Environment, Food and Agriculture raises matters that are not material planning considerations.

The Highways Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways Division cannot be afforded Interested Party Status.
