## Officer's Report

### 1.0 The Site

1.1 The application site is the curtilage of Ballavoddan, Phildraw Road, Ballasalla which is a site to the southern side of the highway. There is a dwelling which has had approval on the site and is currently under construction. The access to the site has been created and the stone wall boundary wall has been constructed.

### 2.0 The Proposal

2.1 The application seeks approval for the erection of entrance walls, pillars and gates which is partly retrospective. The walls and pillars have been constructed.

2.2 Also proposed is the installation of detailing to the gates which includes re-constituted stone pier caps and copings.

2.3 The application also proposes the installation of black painted metal gates.

### 3.0 Planning History

3.1 The following previous applications are considered to be specifically material in the assessment of the current application: PA 07/02378/B Erection of a dwelling, with associated garages, vehicle access and landscaping – approved PA 09/00023/B Erection of a dwelling (amendment to PA 07/02378/B) – approved

### 4.0 Development Plan Policies

4.1 The application site is within an area zoned as “Proposed Low Density Housing in Parkland” identified on the Area Plan for the South 2013. This type of housing development is the subject of Planning Circular 8/89 - Low Density Housing in Parkland which states that all trees within such areas are deemed to be Registered. Development within such areas must take the form of substantial dwellings, designed and finished to the highest quality and each dwellings being sited in at least 1 acre of its own grounds, such as to sit comfortably and naturally in a landscaped setting which acknowledges existing ground contours and existing trees. Satisfactory access and provision of services is also required and any application for such development must include a detailed and accurate survey of all existing trees on site.

4.2 The application is for the access only and there are no specific policies within the Strategic Plan. The points raised under General Policy 2 are general considerations taken into account in the assessment of a development and are considered to be most relevant.

## 4.3 General Policy 2

Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space.

#### 5.0 Consultations

5.1 Highways Division do not oppose 5.2 Malew Commissioners do not object. 5.3 Manx Electricity Authority have expressed an interest.

#### 6.0 Assessment

6.1 The application seeks approval for the installation of entrance walls, pillars and gates. The main issues to consider in the assessment of the application are the impacts upon the character and appearance of the site and landscape and the street scene in general. 6.2 The dwelling which is currently under construction also had approval for an access. The access now proposed does differ from that which was previously approved in that it has different entrance pillars and detailing and is more ornate than that which was previously approved. 6.3 There are a number of properties along the Phildraw Road which are within the Low Density Housing in Parkland zoning and have similar roadside frontages to what is being proposed. There are a number of properties along Phildraw Road which have stone walls therefore the installation of a stone wall along the frontage would be in keeping with the street scene. 6.4 Given the nature of the dwellings in terms of their size and design it is considered that an access of this design is expected. In this location it is considered that the access would be appropriate and would be fairly in keeping with the character and appearance of the area. 6.5 For the above reasons the application is considered to be acceptable and is recommended for approval.

#### 7.0 Party Status

7.1 The local authority, Malew Commissioners is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered an "interested person" and as such should be afforded interested person status.

7.2 The Highways Division of the Department of Infrastructure is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (d), considered an "interested person" and as such should be afforded interested person status.

7.3 The Manx Electricity Authority is not considered to have sufficient interest and therefore should not be afforded interested person status.

Recommendation
