1.1 The above application was approved on 15th October, 2010 subject to a number of conditions, of which the following required the submission of information before the commencement of any works: 2. No development may commence until such time as there is approved by the Planning Authority a scheme for fencing an gating within the estate such that there is no fencing forward of the front building line to the estate road but so there is no unrestricted access from the front of each dwelling to the rear garden The scheme shall be implemented as approved. 3. No development may commence until details of the precise alignment of the spur of the site access road serving Plots 18 to 21 have been agreed in writing by the Planning Authority in conjunction with the Highway Division and the works shall be undertaken as agreed. 4. No development may commence on the dwellings on Plots 1 and 2 until such time as there is approved by the Planning Authority a scheme showing adequate space for the turning of vehicles within Plot 1 such that vehicles may enter and leave the site in a forward gear without having to encroach onto other private property and the scheme shall be implemented as approved prior to the occupation of the dwellings in question. 5. No development may commence on Plot 17 until such time as there is approved by the Planning Authority a scheme showing the relocation of the garage further from the southern boundary hedge and further planting introduced in the space between the boundary hedge and the garage and the scheme shall be implemented as approved. 1.2 In addition, a condition (number 3) required that no development commence until there is in place provision for affordable housing either in the form of affordable housing on site, or a commuted sum.

### Proposal

2.1 The applicant submitted a plan reference 0700/PL12 G in 2008 in response to these same conditions which were attached to the earlier application, PA 07/01465 and were considered to satisfy conditions 4,7 and 10 (see letter dated 19th September, 2011).

2.2 The same plan is now submitted to satisfy conditions 4, 7, 9 and 10. The fencing is shown to be erected from the rear boundary through to the frontage of each property with no fencing forward of this. In the case of plots 18-21, the fencing is shown to extend both in front and behind the dwellings to the estate road although the annotation on the plan states, "No fencing to be erected beyond the front line of each property." This was found to be previously acceptable.

2.3 The plan also shows the alignment of the spur serving plots 18-21 which was considered acceptable in the previous application.

2.4 The Plan also shows provisions for vehicular turning on plots 1 and 2 such that vehicles can access and egress the plots in a forward gear.

2.5 Finally the plan also shows the relocation of the garage on plot 17 further from the southern boundary as required.

2.6 There remain other conditions which control the timing of the development but which will be satisfied as the development progresses. No other conditions require to be satisfied in order for the development to commence.

**Recommendation** 3.1 It is considered that the proposal satisfies conditions 4, 7, 9 and 10. Miss Sarah Corlett
