### Officer's Report

### The Site

The application site relates to the first floor of 1 Lake Road, Douglas. The existing use of the site is as office accommodation. The ground floor is used as a chiropractic clinic.

### The Proposal

The application seeks approval for the change of use to retail and health clinic to provide orthotics, podiatry and other foot and hand treatments. There would be no alterations to the appearance of the property, with just internal alterations to provide three treatment rooms. The applicant's have secured three dedicated parking spaces adjacent to the application site.

### Planning History

The following previous applications are considered specifically material in the assessment of the current application:

PA 07/01294/B Erection of a second floor for residential use, conversion of part of ground floor to residential garaging, bin storage/utility and conversion of first floor to office and residential in association with new second floor.

The above applications were permitted.

## Development Plan Policies

The application site is in an area zoned as "Mixed Use Town Centre" identified on the Douglas Local Plan 1998. It is appropriate to consider the relevant points from General Policy 2 of the Isle of Man Strategic Plan (20th June 2007).

### Consultations

Highways Division wish to defer, in summary the following comments have been made - Health clinics require 3 parking spaces per treatment room and spaces for staff. This proposal offers three parking spaces, further parking survey is required in how the applicant is going to provide the parking spaces. Tesco's car park is not to be taken into account when considering the parking. Highways Division have visited the site and now wish to withdraw their objection, Highways Division do not oppose the application. Douglas Corporation does not object

### Assessment

Given the nature of the proposed development it is appropriate to consider the following points from General Policy 2, which are:
"(c) does not affect adversely the character of the surrounding landscape or townscape;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space."

The application seeks approval for the change of use to retail and a health clinic, the site is within an area zoned as "mixed use Town centre" identified on the Douglas Local Plan 1998, therefore the change of use would be acceptable in principle.

The proposed change of use would have a neutral impact on the character and appearance of the building and the surrounding area.

The main issue that needs considering is the potential impact to parking and highways safety. In terms of parking, for Medical/Health Services Appendix 7 of the Isle of Man Strategic Plan (20th June 2007) requires 3 spaces per consulting room plus staff parking.

The proposed development would have three designated parking spaces to the front of the building which would be utilised by clients, there is also a pay and display car park within walking distance of the application site which will be used by clients if the three parking spaces are already in use. The applicant has advised that the staff will be using the pay and display parking.

Although there would only be three parking spaces to be utilised by clients, there are a number of pay and display car parks, disc parking and a public car park time limited to 2 hours. Treatments would generally last between 20 minutes and 1 hour, so would not exceed the 2 hour time limit.

The application site is within an area zoned as "Mixed Use Town Centre" and is within a reasonable distance of existing public transport routes, there is also a number of pay and display car parks within close proximity of the application site, the applicant also has three parking spaces available to the front of the building which would be used for client parking.

It is considered that the proposed change of use would not result in an increase in on street parking or be detrimental to highways safety. For the above reasons the application is considered acceptable and is recommended for approval. **PARTY STATUS**

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
