### Officer's Report

#### The Site

The site is the curtilage of number 16 Malew Street which links Malew Street with Castle Quay and which encompasses a planted garden area and a small single storey outbuilding which abuts the rear of 4, Bank Street. This outbuilding has a timber pergola at its front and there are three top hung timber casements in the front of the building looking into the garden area.

The site is residential in use.

#### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Southern Area Plan which was published on 23rd October, 2009 as Mixed Use. The site also lies within Castletown's Conservation Area.

#### Planning History

The following applications have been submitted in respect of this site:

PA 01/0648 - alterations to garage and erection of pergola - permitted<br/> PA 05/0556 - erection of small summerhouse - permitted

#### The Proposal

Proposed now is the replacement of the existing casement windows with sliding sashes. The apertures will be lengthened slightly (by 334mm).

## Representations

Castletown Commissioners indicate that they do not oppose the application.

### Assessment

The site lies within a Conservation Area where there is a requirement for the preservation or enhancement of property. In this case the windows are not generally publicly visible but the proposed changes will restore what would have been the original form of glazing to the property and thus the application proposes works which would result in an enhancement of the property and should be supported.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
