### Officer's Report

### The Site

The site is the curtilage of Compton House, a three storey building situated on the corner of Parliament Square and Castle Street. To the south is 5, Parliament Square, an office and to the south west is 7, Castle Street - on the ground floor the shop premises of the Manx Electricity Authority and above there are apartments. The site is only the footprint of the building with no other external space. The premises have three floors above ground and a basement which was formerly used as a restaurant and is now unused.

The ground floor of the building has a principal door which leads into the central stair serving the building. There is a second, smaller door to the left which leads down a corridor to a lobby with toilet facilities and stairs to the basement. Access into the basement is from this corridor and also from a second set of steps to the rear.

## PLANNING STATUS

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Southern Area Plan which was published on 23rd October, 2009 as Mixed Use. The site is also within the Conservation Area and the building is Registered (RB 65).

## Planning History

Planning permission has been sought for the following developments on this site:
PA 90/0032 - internal alterations to create additional shop unit - permitted
PA 91/4132 - change of use from retail to estate agent's - permitted
PA 97/0542 - installation of hanging sign - permitted
PA 98/2138 - removal of light and installation of CCTV - permitted
PA 06/0932/0933 - installation of timber framed sliding sash windows - permitted
PA 07/1359/1360 - repairs to front cobbled area, steps and bollards - permitted

### The Proposal

Now proposed is the conversion of the toilet area to a space ancillary to the ground floor offices (for photocopying etc). In the basement the restaurant is to be used for storage. Rooflights and internal doors are to be replaced and internal walling removed, none of which may be viewed by the public. The rear staircase is to be removed and internal walling omitted to create the proposed storage space.

### Representations

Castletown Commissioners and the Highways Authority indicate that they do not oppose the application

The Isle of Man Water and Sewerage Authority indicate the surface water should not be discharged to the main foul sewer. None of the proposed works affect the discharge of surface water and the site is the footprint of the building so if an alternative means of disposal were required then there is no space for a soakaway to be provided.

### Assessment

As the property is within a Conservation Area and the building is Registered, there is a requirement for development to preserve or enhance the building and the Area - Environment Policies 32, 33 and 35. In this case the works are all internal and will not change the appearance or character of the building. The change of use however, could result in a reduction in the number of vehicle trips and parking spaces generated by the occupation of the building as archive storage tends to result in few visits and minimal if any permanent staff presence.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

The Isle of Man Water and Sewerage Authority are a statutory authority and should be afforded party status in this instance.
