### Officer's Report

#### The Site

The application site represents the residential curtilage of 38 Derby Road, Peel. The existing property is a single storey detached bungalow with living accommodation in the roof space. The site adjoins No.36 Derby Road.

#### The Proposal

Proposed is the installation of a dormer window to the rear elevation to provide further living accommodation. Also proposed are internal alterations.

#### Planning History

The previous planning applications are not considered specifically material in the assessment of the current application.

#### Development Plan Policies

The application site is within an area zoned as "Predominantly Residential" identified on the Peel Local Plan 1989. It is appropriate to consider the relevant points from General Policy 2 of the Isle of Man Strategic Plan (20th June 2007).

#### Consultations

Peel Commissioners have not commented.

Highways Division have not commented.

## Assessment

Given the nature of the application it is appropriate to consider the relevant points from General Policy 2, which are:
"(c) does not affect adversely the character of the surrounding landscape or townscape;
- (g) does not affect adversely the amenity of local residents or the character of the locality."

The application seeks approval for the creation of a dormer in the rear elevation. The rear elevation does not overlook any properties to the rear; it is considered that the installation of a dormer would not result in undue overlooking to the neighbouring properties.

The proposed dormer is considered to be a modest addition to the existing property; it is judged that the proposal would not have a harmful impact on the appearance and character of the property or the surrounding area in general.

It is considered that the proposed development would not be detrimental to the amenities of local residents.

For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
