### Officer's Report

### The Site

The application sire represents the curtilage of Harp Inn, Cross Four Ways, Ballasalla. The existing property is a two storey semi detached cottage situated to the East of Malew Road.

### The Proposal

Proposed is the installation of replacement windows and doors in the front, rear and side elevations. The windows and doors would be replaced with uPVC Cottage style windows and doors with external glazing bars. The traditional front door would be replaced with uPVC front door with dark blue finish.

### Planning History

The following previous planning application is considered specifically material in the assessment of the current application: PA 04/01310/B Replacement of softwood double glazed windows Georgian style with uPVC double glazed windows Georgian style The above application was permitted.

## Development Plan Policies

The application site is within an area recognised as an "Area of High Landscape Value or Coastal Value and Scenic Significance" identified on the 1982 Development Plan. It is appropriate to consider Planning Circular 1/98.

### Consultations

Highways Division have not commented.

Malew Commissioners do not object.

### Assessment

Given the nature of the application, it is appropriate to consider Planning Circular 1/98 which states:

"In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable or the existing windows are not the originals, the preference will be for replacement windows on the said principal elevations, to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."

The existing windows are uPVC and have Georgian glazing bars and sections. The windows are side opening casements and are not the originals; the replacement windows would also be side opening casements.

The replacement windows would be white uPVC with Georgian glazing bars and sections and the replacement front door would be of a traditional style in uPVC and would have a dark blue finish.

The replacement windows would have similar glazing bars and sections as the existing windows. It is considered that the replacement windows would not be detrimental to the character and appearance of the property, although they would not have the original method of opening; the glazing bars and sections would be similar.

It is considered that the proposed development would not be detrimental to the character and appearance of the property and the surrounding area in general.

For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
