# Refusal Decision Notice

## Town and Country Planning Act 1999

## Town and Country (Development Procedure) Order 2005

Mr R Corkhill
The Railway Inn
Main Road
Union Mills
Braddan
Isle of Man

In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Infrastructure does hereby REFUSE the following application made on behalf of:

**Name:** Mr Alan Thompson
**Proposal:** Creation of hard standing and vehicular access onto Victoria Road, Clarecourt
at: Marathon Road
Douglas
Isle of Man
IM2 4HL

which was considered on 16th December 2010, for the reasons set out below.

**Date of Issue:** 23rd December 2010

Murray House
Mount Havelock
Douglas

Mrs P Faragher
Deputy Secretary to the Planning Committee

### Reason(S) For Refusal:

1. Whilst the access is designed to meet highway standards, due to its location on a busy road, with cars parked directly opposite, the proposal would be likely to give rise to increased conflicts for highway users and thereby greater interruption to the safe and free flow of traffic.

2. The proposed works required to create the access, being a reduction in the height of the wall and the gap created in an otherwise continuous frontage, would be harmful to visual amenities and detrimental to the character of the area.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
