### Officer's Report

#### The Site

The application site represents the curtilage of 2 Station Road, Peel. The existing property is a three-storey mid-terrace situated to the North of Station Road. The property adjoins No.4 Station Road and No.6 Patrick Street. To the rear of the property there is access to the lower ground floor.

#### The Proposal

Proposed is the erection of a four-storey extension to the rear of the property. The rear of the extension would project to the rear of the neighbouring property, but would not project beyond the rear elevation.

The windows would be sliding sash in either timber or uPVC, the bathroom window would be obscure glazed.

#### Planning History

There are no previous planning applications relating to this site.

#### Development Plan Policies

The application site is within an area zoned as "mixed use" which is identified on the Peel Local Plan 1989, it is also within the Peel Conservation Area. It is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).

#### Consultations

Highways Division has not commented

30 July 2010 10/00930/B Page 1 of 3

Peel Commissioners recommend that the application be approved.

**ASSESSMENT**

Given the nature of the proposal it is appropriate to consider Environment Policy 35, which states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

It is considered that the proposed development would not result in a harmful impact to the neighbouring properties or the appearance and character of the Conservation Area. The proposed extension would be to the rear of the building and would not result in overlooking to neighbouring properties, as the application site does not directly look toward any buildings to the rear. The proposed extension would not project further than the rear elevation of the neighbouring property, therefore the proposal would not result in a massing effect to 4 Station Road.

Given that the extension would be to the rear, it is not considered that it would have a harmful impact to the character and appearance of the street scene in general.

The windows to be installed would be sliding sash, which would add to the character of the Conservation Area. For the above reasons the application is considered to be acceptable and is therefore recommended for approval. **PARTY STATUS**

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
