### Officer's Report

### The Site

The application site comprises the curtilage of 16 Cronk Avenue, Birch Hill Park, Onchan. The property is a two-storey semi-detached residential dwelling, located within a residential area.

### The Proposal

Proposed are alterations to the driveway. The proposal includes extending the existing driveway and finishing it with block paving.

### Planning History

There are no previous planning applications considered relevant in the assessment and determination of this application.

## Development Plan Policies

In terms of local plan policy, the application site is located within an area designated as Predominantly Residential Use in the Onchan Local Plan Order 2000. The site is not within a Conservation Area.

The following policy from the Isle of Man Strategic Plan 2007 is considered material to the assessment of this current planning application;

General Policy 2;
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees anc. sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;
- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption."

### Representations

The Department of Infrastructure Highways Division do not object to this application, as there are no traffic management, parking or road safety implications. The Division have included a note stating that the applicant shall contact the Network Operations Section of the Department prior to carrying out any works within the highway, including the installation of dropped kerbs.

Onchan District Commissioners recommend that the application be approved. The Drainage Division of the Isle of Man Water and Sewerage Authority do not object to the application, on the condition that no surface water is discharged from the proposed development to any foul drainage, in order to comply with the requirements of the Sewerage Act 1999.

### Assessment

The principal issues in assessing this application are whether the proposal complies with parts (b), (c) (g) and (h) from General Policy 2 of the Isle of Man Strategic Plan 2007, in that it would not have a detrimental impact on residential amenity or the character of the site, or any highway or parking issues.

This proposal would extend the existing driveway northwards to the boundary with the adjacent property and southwards into the grassy area incorporating the existing path, but retaining much of the area for grass. The proposed driveway would be finished with a block paving and the paving would also extend to the path area around the existing garage.

From a site visit, it was noted that some of the neighbouring properties have also extended and paved their drives, which has only had a small visual impact. This proposal is therefore judged not to be detrimental to the residential amenity or character of the area.

The proposed driveway would cover a wider area than the existing driveway, enabling more room for vehicles to park and manoeuvre. There would therefore be no highway or parking issues

The scale and form of this development are deemed to be appropriate for the development site. The proposal complies with parts (b), (c), (g) and (h) from General Policy 2 of the Isle of Man Strategic Plan 2007 and is unobjectionable.

RECOMMENDATION

For the above reasons this application is considered to be acceptable and is recommended for approval.

## PARTY STATUS

It is considered that the following parties, who submitted comments, should be afforded Interested Party Status; Onchan Parish Commissioners. It is considered that the following parties, who submitted comments, should not be afforded Interested Party Status;

The Highways Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways Division cannot be afforded party status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the extension of the existing driveway, as shown in the photographs, boundary map, building plot layout, existing plan and proposed plan, received the 4th May 2010.
