In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby **APPROVE** the following application made on behalf of:

which was considered on 13th July 2010, subject to compliance with the **conditions** specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the partial conversion of existing garage to provide tourist living accommodation as proposed in the submitted documents and drawings 259/2/1, 259/2/3 and 259/2/4 all received on 27th May 2010.

3. The units may be used only as tourist accommodation where tourism is defined as set out below in accordance with the provisions of the Strategic Plan and for clarification may not be occupied as a person's main place of residence.

Tourism has been defined by the Tourism Society as "the temporary short term movement of people to destinations outside the places where they normally live and work and their activities during their stay at these destinations" and it covers a very wide range of activities and types of development. This may include travel and visits for business, professional and domestic purposes as well as for holidays and recreation.
4. No continuous stay may exceed 4 weeks in duration and there shall be no return within 2 months unless otherwise agreed in writing with the Planning Authority.
5. The external finishes of the extension must match those of the existing building in all respects.

NOTE The applicant is advised that any future application for further garaging is likely to be viewed in a negative manner, given the proposal submitted and approved under this application would remove two existing garages within the site.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

## Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
