## Department Of Infrastructure ### Memorandum To: Jennifer Chance, Development Control Manager From: Ian Brooks, Planning Officer Subject: Compliance with Conditions: PA 10/00480/B - Approval in principle for a phased redevelopment of part of the Upper Pulrose Estate comprising 42 apartments, 42 dwelling houses, 35 sheltered apartments and a Police Office (discharging siting and means of access for all phases and discharging all reserved matters for Phase 8 only), Upper Pulrose Estate Date: To consider the submission of details in accordance with conditions 7 and 15 of Planning Permission 10/00480/B, which was granted on 1st October 2010. Condition 7 stated: "No phase of development shall take place until samples of the facing, roofing and paving materials for that phase have been submitted to and approved by the Planning Authority, and these works shall be carried out in accordance with the approved details for that phase." The applicant's agent has submitted samples along with a list detailing the make and type of materials that have been submitted for approval. I consider the samples submitted to be acceptable and accordingly, it is recommended that the details for condition 7 be approved. Condition 15 stated: "No development or other operations shall be commenced on this site until adequate steps, which shall have been previously approved in writing by the planning authority, have taken to safeguard against damage or injury during construction works all trees on the site, or those trees whose root structure may extend within the site. In particular no excavations, site works, trenches or channels shall be cut or pipes or services laid or any other works carried out in such a way as to cause damage or injury to the trees by interference with their root structure and no soil or waste shall be deposited on the land in such a position as to be likely to cause damage or injury to the trees." I consider the details submitted to be acceptable and accordingly, it is recommended that the details for condition 15 be approved.
