### Officer's Report

#### The Site

The application site represents the curtilage of Field 110330 Ballaskilley Farm Bride. The site is located to the North of the highway; there is an existing Manx Telecom and Cable&Wireless site within the curtilage. The site is in an "Area of High Landscape Value or Coastal Value and Scenic Significance."

#### The Proposal

Proposed is the erection of a building for the storage of golf course maintenance machinery. The building would measure approximately 21m in length, 12m in width and 4.7m in height, all cladding

materials would be coated metal, the roof would be constructed of barge boards and would incorporate 20 GRP roof lights.

PLANNING HISTORY The following previous planning applications are considered relevant in the assessment of the current application:

PA 94/00442/B Creation of 18-hole golf course with clubhouse & associated facilities. PA 01/01418/B Temporary location of two former holiday chalets for use as changing rooms. PA 06/01109/B Installation of an automatic turf irrigation system, water retention tank/pump house and floating pump.

The above applications were approved.

DEVELOPMENT PLAN POLICIES Due to the location of the site, it is zoned as an "Area of High Landscape Value or Coastal Value and Scenic Significance" identified on the 1982 Development Plan. The proposal should be assessed in light of Environment Policy 2 and General Policy 3 from the Isle of Man Strategic Plan (20th June 2007).

CONSULTATIONS Manx Electricity Authority has requested that a condition of planning be that the applicant must contact the Authority. Department of Transport Highways and Traffic Division do not oppose as it has no traffic management, parking or road safety implications. Bride Commissioners have no objection with the proposal. Owners/Occupiers of Glebe Cottage Maughold have commented on the proposed use. They do not object to the proposal, but feel it should be described as recreational.

ASSESSMENT It is appropriate that in the assessment of the proposal the relevant policies are considered. Environment Policy 2 which is mentioned above states:

"The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance as shown on the 1982 Development Plan and subsequent Local and Area Plans will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein. Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that:

- (a) The development would not harm the character and quality of the landscape; or
- (b) The location for the development is essential."

In terms of the character and quality of the landscape, it is considered that the proposal would not have an adverse impact due to the existing boundary treatment, and the proposed installation of further trees. The boundary treatment would work as screening of the building, therefore having less of a visual impact on neighbouring properties and local residents. Although the development would have an impact on the landscape, it is not considered to be detrimental to the character and quality.

The application site is within the curtilage of the golf course, which is an established business within the site. The erection of a building to house golf course maintenance machinery is judged to be acceptable within the site, as it is a need for the business.

There are currently no buildings on site which are suitable for the housing of equipment of this size. The location of the proposed building is considered to be acceptable as in this instance it is not practicable to locate it adjacent to the existing buildings as it would encroach onto the golf course.

It is appropriate that General Policy 3 should be used in the assessment of the proposal which states:

"Development will not be permitted outside of those areas which are zoned for development on the appropriate Area Plan with the exception of:

- (a) Essential housing for agricultural workers who have to live close to their place of work; (Housing Policies 7, 8, 9 and 10);

- (b) Conversion of redundant rural buildings which are of architectural, historic or social value and interest; (Housing Policy 11)

- (c) Previously developed land which contains a significant amount of building; where the continued use is redundant; where redevelopment would reduce the impact of the current situation on the landscape or the wider environment;

- (d) The replacement of existing rural dwellings; (Housing Policies 12, 13 and 14) (e) Location-dependant development in connection with the working of minerals or the provision of necessary services; (f) Building and engineering operations which are essential for the conduct of agriculture or forestry;

- (g) Development recognised to be of overriding national need in land use planning terms and for which there is no reasonable and acceptable alternative; and

- (h) Buildings or works required for interpretation of the countryside, its wildlife or heritage."

It is considered that the proposed development is essential in the maintenance and security of machinery that is used for the existing business on site, currently there are no alternative structures that could be used for this purpose.

The building would be clad in coated metal sheets, which would be painted green, and further trees would be planted as to screen the building.

For the above reasons the application is considered acceptable, and is recommended for approval.

## PARTY STATUS

The Local Authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

It is considered that the following party does not meet the criteria of Government Circular 1/06 of the Town and Country Planning (Development Procedure) Order 2006 and should not be afforded party status:

Owners/Occupiers of Glebe Cottage Maughold

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a building to store farm and golf course maintenance equipment shown in drawings PA-01, PA-02, PA-03 (P4282-01), PA-04 and photographs PA-05A and PA-05B date stamped 28th January 2010.

C 3. All cladding materials to be green coated metal sheeting or such other colour as may be agreed in writing by the Planning Authority.

C 4. On completion of the proposed building, the proposed hedging/banking is to be planted/created. The planting is required to take place in the first planting and seeding seasons. Any trees or shrub which within 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species unless the planning authority gives written consent to any variation.

I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
