### Officer's Report

### The Site

The site represents the curtilage of the Rushen Abbey Hotel, situated alongside the ford at the western side of Mill Road and to the north of Rushen Abbey itself. To the north west of the hotel is a car park and to the north is the Monk's Path leading to Silverdale. The hotel has recently undergone renovation and restoration work, all undertaken by Manx National Heritage who also operate the interpretative site to the south.

### Planning Status

The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as High Landscape Value and Scenic Significance. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area of Residential use. The site also lies within the Silverdale Conservation Area.

### Assessment

The proposal should be considered in respect of Planning Policy Statement 1/01 and Environment Policy 35 which states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development".

In this case the ducting will not be visible from outwith the side and is an essential part of providing hot food within the building, which will complement the facilities available at the historical site.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
