### The Site

The application site relates to 37 Faaie Ny Cabbal, Kirk Michael, a semi detached dwelling situated within a modern cul-de-sac.

### The Proposal

This application seeks approval for the erection of a single storey extension to the rear of the property to provide a sun room.

### Planning Status

The application site is located within an area identified as being residential by the Kirk Michael Local Plan. Within the Isle of Man Strategic Plan 2007, General Policy 2 is relevant. This sets out the general requirements which developments in areas zoned for development should meet.

The following previous planning application is considered relevant in the assessment and determination of this application:

04/01774/B sought approval for the erection of an extension above an existing garage. This was permitted.

## Representations

Highways Division does not object to this application. Michael Commissioners do not object to this application. Drainage Division does not object to this application subject to there being no surface water discharge to any foul sewer system.

### Assessment

The proposed development is of a size and form which would normally fall within the allowances of the Permitted Development Order however as the property has already benefited from an extension, this additional extension requires planning permission.

The proposed extension would have a pitched roof and would be set back from either adjacent boundary by at least 1.9 metres. It is judged that this set back combined with the modest scale of the extension would prevent any unacceptable impacts upon the amenity of neighbouring properties.

The extension would not be visible to the public and in any case is appropriate to the existing dwelling so as to be in-keeping.

It is concluded that the proposal is unobjectionable.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Accordingly the following parties are not granted Interested Party Status:
The Department of Transport Highways and Traffic Division and the Drainage Division are now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division and the Drainage Division cannot be afforded party status in this instance.

C 2. This approval relates to the erection of an extension to dwelling house, 37 Faaie Ny Cabbal, Kirk Michael, as shown by 4294/LP1 and 4294/SP1 received 23rd February 2010 and 4294/1 REV A received 23rd April 2010.

C 3. The external finishes of the extension must match those of the existing building in all respects.
