### Officer's Report

#### The Site

The application site represents the curtilage of 28 Third Avenue Onchan. The existing property is an end of terrace dwelling located in an area of Predominantly Residential Use identified on the Onchan Local Plan 2000 on the North Side of Third Avenue.

#### The Proposal

Proposed is the creation of vehicular access and driveway to the front elevation of the property. The existing gate and wall would be removed and the wall adjoining the neighbouring property made good. The driveway would be brick paved in a herring bone pattern. Also proposed are the alterations to the existing pedestrian walkway directly outside the property creating the installation of a dropped kerb.

#### Planning History

There are no previous planning applications for this site.

#### Development Plan Policies

The application site is within an area zoned as Predominantly Residential Use identified on the Onchan Local Plan 2000. It is appropriate to consider General Policy 2 of the Isle of Man Strategic Plan (20th June 2007).

Highways Division do not oppose as it has no traffic management, parking or road safety implications. Onchan Commissioners recommend that the proposal be approved.

## Assessment

The proposed development should be assessed against the relevant points from General Policy 2, which are:
'(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (g) does not affect adversely the amenity of local residents or the character of the locality"

Having assessed the proposed development against the above policy, it is considered that the proposal would be acceptable in terms of respecting the site and surrounding area.

The properties in the surrounding area are of similar style and design, and have already created similar access, and it is judged that the proposal would have little impact on the streetscape. It is thought that the character would not be adversely affected by the proposal and would not have a negative impact on the area.

There would be no detrimental impact on the amenity of local residents, there would be a visual impact, but it would not be considered as harmful.

Third Avenue is a highly populated area for on street parking, it is thought that the creation of a paved parking area within the curtilage of the site would help improve the parking within the area.

For the above reasons the application is considered acceptable, and is recommended for approval.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
