### Officer's Report

### The Site

The site represents a piece of land within Balthane Industrial estate, on the north western side of the estate road, to the south of the main Balthane Road which runs through the estate towards Turkeyland Quarries. The site lies to the rear of an existing building operated and occupied by the applicant, and which fronts onto the estate road. There is a second building to the south west of this, also owned by the applicant (see Planning History). Access to both the proposed site and the approved building are to the side of the existing main building.

## Planning Status

The site lies within an area of Industrial use on the Town and Country Planning (Development Plan) Order 1982 as "white land" but is clearly part of the developed and serviced Balthane Industrial estate which abuts the Freeport. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area of Industrial use and is outwith the hazard zone centering on the gas tanks within the estate.

### Planning History

Planning permission has been sought previously on the adjacent land for nine industrial units under PA 02/2000, 04/0684, 08/0338 and 09/0730.

### The Proposal

Now proposed is the erection of further industrial units, similar to those already approved on the adjacent plot, but with a larger overall footprint and thus a larger mass of building. The building will be 54 m long and 36 m wide and 7.2 m to the ridge. 44 parking spaces are provided around the building and there is to be 1836 sq. which equates to one space per 41 sq. m which is in excess of the 1:50 ratio required by the Strategic Plan for industrial development. The building will be 0.5 m higher in terms of its floor level than the building fronting onto the estate road and similar to the average level of the stepped building to the south and a similar building height.

The building will be clad in grey sheeting - roof and walls.

### Representations

Department of Transport Highways and Traffic Division and Malew Parish Commissioners indicate that they do not oppose the application

Department of Transport Drainage Division seek a deferral pending surface water calculations to be provided by the applicant. Subsequent correspondence indicates that they would accept a condition requiring approval of the final calculations prior to the commencement of works on site

Department of Trade and Industry clarify that the unit will be used by Laserflex Ltd who manufacture high-tec printing equipment which is currently based in Balthane and wish to move to larger premises including operations which are presently based in the UK, and support the application

Malew Parish Commissioners raise no objection to the application The Manx Electricity Authority make comments relating to the provision of electricity supply and the existing services on the site. Neither is a planning matter and the existing services can be referred to by note.

### Assessment

The site lies within an area which has been developed and is being used for industrial purposes. Access to the site is around an existing industrial building owned and operated by the applicant and the building is of a size, appearance and finish to match those in the vicinity. Further investment in Balthane is to be encouraged and as such, this application is considered not to have any adverse impacts and should be approved.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Department of Trade and Industry raise issues which are material planning considerations and should be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the construction of an industrial unit with associated car parking as shown in drawings GA1, GA2, GA3, GA4, GA1/1250 and GA200 all received on 2nd February, 2010.

C 3. Notwithstanding the details submitted, further details of the means of surface water drainage shall be submitted to and approved in writing by the Planning Authority prior to the commencement of building works on site: such details shall include the final discharge figure from the proposed development into the public sewer.

N 4. The applicant is advised to consult the Manx Electricity Authority in respect of future and existing electricity supplies to and on the site.
