### Officer's Report

This application is recommended for consideration by the Planning Committee rather than under delegated powers as previous applications for the site were considered by the Planning Committee and as such to maintain consistency in the decision making process it is recommended that the Committee determine this proposal.

### The Site

The site relates to parts of Field 315097 which is to the east of the residential development Reayrt Ny Keylley and to the south of Poortown Road, Peel. The site is currently being developed with housing under the provisions of 09/00521/B.

The site is part of a larger area designated as being Predominantly Residential use by the Peel Local Plan (Planning Circular 6/89).

### Proposal

This application seeks approval for the erection of 7 dwellings on plots A37 to A43. The application proposes relatively minor alterations to the approved development with the external finishes of five of the dwellings being altered to include the use of more Manx stone. The rear boundaries of plots A37

and A38 would be amended by removing part of the rear access lane resulting in larger rear gardens and better security.

## Planning History

The wider site has been the subject of a previous application, 06/01393/A which sought approval in principle for the residential development of Fields311825, 311826, 311827, 314444 and 315097, Ballawattleworth Farm in accordance with the densities and indicative highway layout shown on the enclosed master plan. This application proposed a total of 458 dwellings. The Planning Committee resolved to refuse this application.

PA09/00521/B sought approval for a residential development of 43 dwellings including roads, drainage infrastructure and public open space. This was refused by the Planning Committee but was approved at appeal.

PA09/00883/R sought retrospective approval for the temporary storage of construction materials from housing development site, field 315097, adjacent to housing development under construction (Reayrt Ny Keylley). This was refused by the Planning Committee.

### Planning Status

The site is identified within the Peel Local Plan as being Proposed Residential. Within the Isle of Man Strategic Plan the following policies are considered relevant to the determination of this application:

Strategic Policy 3, which states:
"Proposals for development must ensure that the individual character of our towns and villages is protected or enhanced by:
- (a) avoiding coalescence and maintaining adequate physical separation between settlements; and
- (b) having regard in the design of new development to the use of local materials and character."

Strategic Policy 5, which states:
"New development, including individual buildings, should be designed so as to make a positive contribution to the environment of the Island. In appropriate cases the Department will require planning applications to be supported by a Design Statement which will be required to take account of the Strategic Aim and Policies."

General Policy 2;
Environmental Policy 42, which states:
"New development in existing settlements must be designed to take account of the particular character and identity, in terms of buildings and landscape features of the immediate locality. Inappropriate backland development, and the removal of open or green spaces which contribute to the visual amenity and sense of place of a particular area will not be permitted. Those open or green spaces which are to be preserved will be identified in Area Plans."

### Representations

The Highways Division does not object to this application. Peel Town Commissioners do not object to this application.

### Assessment

The amendments proposed to the approved development represent improvements to the visual appearance of the dwellings in question and improved amenity and security to the dwellings to be built on plots A37 and A38. It is recommended that this application be approved.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Peel Town Commissioners

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the erection of seven dwellings, plots A37 to A43 of approved residential development, Part of Field 315097, Adjoining Reayrt Ny Keylley, to the south of Derby Road/Poortown Road as shown by 2313/2/101, 2313/2/100[PART] A, 2313/2/112 [PART] A, 2313/2/108/A, 2313/2/109/A, 2313/2/110/A, 2313/2/111/A and 2313/2/106 all received 17th February 2010.

C 3. Prior to the occupation of the dwellings, the road layout shown by approved drawing 2313/2/113 of PA09/00521/B, including parking areas, must be laid to at least base course level and the parking associated with the development must be available for the use by occupiers of the dwellings.
