### Officer's Report

#### The Site

The site represents part of Noble's Park, a part alongside the access road which links Duke's Road with Glenc Hutchery Road and which is opposite the rear of numbers 29-41 (odd numbers only). Victoria Road. The site is grassed although recent use during TT and Grand Prix periods has resulted in wear of the grass and tracks being scored into the site. The edge of the site alongside the access road is fenced off with 2m high green post and mesh fencing.

#### Planning Status

The site lies within an area of Public Open Space which also includes the hardstanding to the rear of the grandstand and the paddock area to the north east of this which is used in race periods for the parking of racer's vehicles and use of the area for bike repairs and maintenance during the race period.

#### Planning History

Planning permission was sought and refused for the installation of an open air storage compound within the hard surfaced area at the south western side of the site. This application, PA 10/0250 was refused for reasons relating to its appearance and to the principle of introducing a building within an area of Public Open Space.

#### The Proposal

Proposed now is the creation of roadways within the site. The aim is to provide formal access ways and avoid the damage and visual impact which resulted from heavy use in periods of inclement weather. The roads will be 5 m wide and constructed with a planings finish over road stone beneath which will be a membrane with gravel topped boards at the sides, all dug out to a depth of 150 mm . The roads will form a rectangle within the site with an emergency access onto the access road alongside the rear of Victoria Avenue.

The proposal will formalise tracks which have been formed through use over time.

### Assessment

The proposal does not propose any structures and as such does not compromise the designation of the land as Public Open Space. The area is used as a paddock during race periods and the proposal will enhance this use and visually improve an area which is becoming worn and where vehicles may not use the area in periods of heavy rain, including emergency vehicles which have previously become stuck.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
