In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 19th March 2010, for the reasons set out below.

### Reason(S) For Refusal:

1. The proposed vehicular access would be contrary to General Policy 2, Transport Policy 4 and 6 of the Isle of Man Strategic Plan 2007 in that:
   1. The proposed vehicular access provides for no visibility of the adjacent footpath and would therefore present a serious risk of harm to pedestrian safety; and
   2. The proposed vehicular access would result in vehicles overhanging the footway and main carriageway, which will result in vehicles that use Victoria Road having to manoeuvre around the vehicle entering and exiting the site, which will be detrimental to highway safety and the free flow of traffic.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
