## Planning Statement In Support Of An Application For A Certificate Of Lawful Development In Respect Of An Enlarged Conservatory, Trollaby House, Trollaby Lane, Union Mills, Braddan, Im4 4Aw

#### 1.0 Introduction

1.1 Trollaby House is a detached dwelling which sits on the south western side of Trollaby Lane which is a vehicular route and also a public right of way which connects the A1 TT course with the A23 Crosby Back Road.
1.2 The house was built as a replacement for a previous dwelling on the site, under 89/01850/B and a conservatory was added under 96/00023/B. This was an angled structure which sat half way along the then south western elevation of the house. The current applicants purchased the dwelling in 1995 and have owned it since then.
1.3 Some time in 2005, the owners sought advice from a local window installer regarding the extension of the conservatory as it now exists and were advised that planning approval was not necessary. At that time there was Permitted Development for extending properties but the amount of floorspace allowed would have already have been taken up by the existing angled conservatory and in addition, a further extension had been added under 00/01886/B to the rear of the property. This followed a previous unsuccessful application for a larger extension, which was refused at appeal - 00/00093/B. This rear extension was implemented and exists today as does the extension to the conservatory, which was implemented in the faith that as advised, planning approval was not required.
1.4 The house is in the process of being sold and the purchasers' advocates have advised that a Certificate of Lawful Development should be obtained to enable the extended conservatory to become lawful, in the knowledge that structures constructed four years ago

or earlier are immune from the issue of an enforcement notice under Schedule 4(3)a of the Town and Country Planning Act 1999. 1.5 Below are photographs of the conservatory as it exists today.

### 2.0 Evidence of the age of the structure

2.1 Below are aerial photographs kindly provided by the Department which date from 2012 and 2015 both of which show the extended conservatory in situ as it exists today.

2.2 In addition, attached is a quotation from the conservatory supplier dated 01.04.05 and photographs of the conservatory being used dating from before 2017.

#### 3.0 Conclusion

3.1 We believe that the evidence provided - the aerial photographs, photographs and quotation for the conservatory, cumulatively demonstrate that the conservatory as it exists.

today has been in situ for at least four years and as such a Certificate of Lawful Development should be issued in this case.
3.2 If this evidence is not considered sufficient, we would be grateful if we could be advised so that we will attempt to seek additional evidence as recommended by the Department.
