#### 1.0 The Site

1.1 The application site is the curtilage of Kenilworth, Bay View Road, Port St Mary which is a three storey mid terrace property situated to the south western side of Bay View Road. There is a shop at ground floor the rest of the building is traditional in appearance and has retained its traditional timber sliding sash windows.

#### 2.0 The Proposal

2.1 The application seeks approval for the installation of replacement windows in the front elevation. The windows would be sliding sash uPVC at first and second floor with a radius window within the roof space, this would be non opening.

#### 3.0 Planning History

3.1 The following two applications are relevant in the assessment of the current application, PA 88/00172/D Erection of illuminated sign which was approved and PA 03/01310/B Installation of a replacement shop front, this was also approved.

#### 4.0 Development Plan Policies

4.1 The application site is within an area zoned as "Mixed Use" identified on the Area Plan for the South 2013. It is also within the Proposed Conservation Area. Given the nature of the application it is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007) and Planning Circular 1/98.

#### 5.0 Environment Policy 35

5.1 Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.

#### 5.2 Planning Circular 1/98

If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare must have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same frame sections as the original windows.

Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.

## 6.0 Consultations

6.1 Port St Mary Commissioners has no objections.

#### 7.0 Assessment

7.1 The application seeks approval for the installation of replacement windows in the front elevation. The main issue to consider in the assessment of the application is the impact upon the character and appearance of the Proposed Conservation Area and street scene in general. 7.2 The proposed windows on the first and second floors would have the same method of opening and glazing sections as the existing, and therefore they would comply with Planning Circular 1/98. The window in the third floor would be a fixed unit but would still have the same shape as the existing. 7.3 It is considered that the proposed windows would preserve the method of opening and glazing sections and therefore would comply with Environment Policy 35. 7.4 For the above reasons the application is considered to be acceptable and is recommended for approval.

#### 8.0 Party Status

8.1 The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2013, paragraph 6 (4) (e), considered an "interested person" and as such should be afforded party status. 8.2 The Highways Division of the Department of Infrastructure is, by virtue of the Town and Country Planning (Development Procedure) Order 2013, paragraph 6 (4) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
