## The Town And Country Planning Act 1999

## The Town And Country Planning (Development Procedure) Order 2005

TO: Arragon Construction Ltd, PO Box 382, Douglas, IM99 2XA

[Copies as per Circulation List]

In pursuance of his powers under the above Acts and Order the MINISTER for Infrastructure, following report by the appointed person, does hereby REFUSE the application by Arragon Construction Ltd - Erection of ten dwellings with associated parking, Plots 12, 13 and 15-22, Poachers Pocket Development, Bridge Road, Ballasalla for the following reasons:-

1. This proposal would constitute a poorly designed development and would result in an unsatisfactory residential environment; in particular –

(a) the buildings would generally be of a height which would not accord with the principle established by condition (12) of the approval granted in respect of PA 02/702;
(b) the development would be characterised by limited space around and between the proposed houses, and between the proposed and existing houses;
(c) the 2-storey projecting gables would be over-dominant in the street scene; and
(d) the use of varied external finishes would result in an incoherent appearance.
