## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) Order 2005

On 28th January 2013, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to **REFUSE** planning application **12/01125/B** by Mr Frank Sweeney for the residential development of six detached dwellings with garages at Land Adjacent To Ginger Hall Hotel Ballamanagh Road Sulby Isle Of Man for the following **reason(s)**:

1. Whilst the Isle of Man Strategic Plan 2007 seeks the efficient use of land the level of development proposed by this planning application constitutes over intensive development. The increase in numbers of dwellings to six results in an awkward and crammed layout that fails to provide acceptable standards of private amenity for the proposed dwellings and leaves insufficient space for any form of landscaping buffer. As such, the proposal is unacceptably contrary to the provisions of General Policy 2 of the Isle of Man Strategic Plan 2007.

2. The proposed development fails to provide minimum visibility standards of 2.4m x 36m from the application site onto to Ballamanagh Road (B8) to serve six dwellings. As such, the proposal is contrary to the interests of highway safety and fails to meet the provisions of General Policy 2 of the Isle of Man Strategic Plan 2007.
