## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) Order 2005

On 12th November 2012, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to **APPROVE** planning application **12/01254/B** by Mr Ian George Berresford Sims & Mrs Mary Jane Sims for the retention of existing marquee at Barroose House Barroose Road Baldrine Isle Of Man IM4 6AR subject to compliance with the following conditions:

1. This approval relates to the retention of existing marquee, Barroose House, Barroose Road, Baldrine, Lonan as shown by 1, 2, 3 and support letter all received 11th September 2012 and shall inure for the sole benefit of the applicants, Mr and Mrs Sims, for a period of 2 years from the date of this permission, on expiry of which period the structure shall be dismantled and the frame, cladding and all other constituent materials shall be removed permanently from the site.

2. The structure hereby approved shall be used only by the applicants, Mr and Mrs I Sims, and solely for agility training for dogs. Other uses of whatever kind are not permitted, including the use of the structure by or on behalf of other persons for training or competition events.

3. The building must only remain while Mr and Mrs I Sims (the applicants) are resident at Barroose House. Within 1 day of the applicants no longer residing at the site, the use shall cease and the structure shall be dismantled and the frame, cladding and all other constituent materials shall be removed permanently from the site.

4. All of the panels which form the roof of the marquee structure must be white in colour. The existing green panel must be replaced with a white panel by the 1st December 2012 and retained as such thereafter until the entire structure is removed.

5. The storage container labelled 3 on submitted drawing 1 must be removed from the site by the 1st December 2012.

## Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

*Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.*

## Supplementary Report

The application was determined by the Planning Committee at its meeting of 12th November, 2012. The Committee was concerned that if an approval was to be granted without a time restriction for removal, the condition of the marquee may deteriorate further and become unsightly. The Committee determined that the permission should be for a period of two years only. Condition 1 has been amended to reflect this decision.
