## Officer's Report

### 1.0 The Site

1.1 The site represents the residential curtilage of 17 Wallberry Mews, Douglas located on the eastern side of Wallberry Mews and which is accessed via Clybane Rise. The property forms part of a row of four, two storey modern properties (end terrace). To the southern boundary and gable end wall of the property is a public footpath.

### 2.0 Proposal

2.1 The application seeks approval for installation of a flue to the gable end wall (southern elevation) of the property. The flue would project out from the gable wall at a height of 2.8 metre above the public footpath. The flue would then continue upwards by 5.27 metres. The flue would have a diameter of 0.2 metres.

### 3.0 Planning Status

3.1 The application site is within an area recognised as being an area of 'residential use', under the Douglas Local Plan.

3.2 Due to the site location, zoning and the type of proposal, the following policy is relevant for consideration:-

"General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;

- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption."

### 4.0 Planning History

4.1 There are no previous planning applications which are considered relevant in the assessment and determination of this application.

### 5.0 Representations

5.1 No written representations have been recived.

### 6.0 Assessment

6.1 The main issue which needs consideration is the potential impact upon the visual amenities of the street scene. The proposal will be apparent from the road within Wallberry Mews and more prominently when walking along the public footpath. 6.2 Whilst the proposal will have a visual impact it is considered its position, size and design would not result in an significant adverse visual impacts upon the street scene to warrant a refusal.

### 7.0 Recommendation

7.1 For these reasons the proposal is considered to comply with the relevant polices of the Strategic Plan and therefore recommended for an approval.

### 8.0 Party Status

8.1 It is considered that the following meet the criteria of Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d) and should be afforded interested party status:

8.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the installation of a flue as proposed in the submitted documents and drawing P 1497 01 all received on 14th August 2012.
