## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) Order 2005

On 15th October 2012, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to **APPROVE** planning application **12/01128/B** by Isle of Man Water and Sewerage Authority for the erection of a sludge import, thickening and storage facility at Meary Veg Sewage Treatment Works Balnahowe Santon Isle of Man IM4 1HL subject to compliance with the following conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the construction of new sewage treatment facilities and associated access and hardstanding, all as shown in drawings 60159111/600/P2, 60159111/601/P2, 60159111/602/P1, 60159111/603/P1, 60159111/604/P2, 60159111/606/P1, 60159111/607/P1, 60159111/608/P1, 60159111/609/P1, 60159111/610/P1, 60159111/611/P1, 60159111/612/P1, 60159111/613/P1 and the Environmental Appraisal Report, all received on 8th August, 2012.

3. The portions of sod hedge to be removed within the site must be removed prior to the end of October to reduce the risk of harm to any lizards on the site. Such works must be overseen by a qualified ecologist and continued liaison with Department of Environment Food & Agriculture Wildlife Division is encouraged. The material resulting from the removal of any hedgerows within the site must be retained for use in the construction of new Manx sod hedging between the new buildings and the western perimeter of the site. Details of this where this is not shown on the approved drawings must be approved by the Planning Authority prior to the removal of any hedging.

Note: the applicant's attention is drawn to Planning Circular 1/92 - Manx Hedges and the applicant is encouraged to liaise with Department of Environment Food & Agriculture Wildlife Division to ensure that any new hedging is as suitable for lizards as possible.

NOTE The applicant should liaise with the owners of Balnahow Farm, Santon IM4 1HN regarding their concerns about existing and potential smell nuisance.
