I refer to the recent appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.

The Minister has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Planning Authority's Approval of the application under Article 6 of the Town & Country Planning (Development Procedure) Order 2005 should be confirmed subject to the attachment of the 2 planning conditions as detailed in the original decision notice and 2 additional conditions as detailed at paragraph 23 of the Inspector's Report. Formal notice of this decision is attached.

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, does hereby APPROVE planning application 12/01032/B by Mrs Isabel Marion Lawrence for Conversion of existing retail unit to provide residential accommodation, The Longhouse Shop, Viking Longhouse, East Quay, Peel, IM5 1AR (appeal by Mr T Ferrer), subject to the following conditions:

1. This permission relates to the conversion of the retail unit to a dwelling, as shown in drawings 100 and 01 both received on 20 July 2012.
2. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
3. The approval of Drawing No. 100 is subject to the following corrections to that drawing: (i) the reference to 'Proposed first floor plan' should refer to 'Proposed Ground floor drawing'; and, (ii) the reference on the proposed floor plan to a 'new tilt and turn escape door' should refer to a 'new tilt and turn window' to accord with the reference on the 'proposed north elevation'.
4. Prior to the commencement of the development a scheme shall be submitted to, and approved in writing by, the Planning Authority containing details of the 'Flood Defender single door barriers' which the Flood Risk Assessment stated are to be positioned on all external doors to minimise the risk of flooding. These barriers shall be provided in accordance with the approved details prior to occupation of the unit as residential accommodation.
