## Officer's Report

### Introduction

1. This application seeks permission for the installation of roof lights in a residential property. The application is considered to be acceptable and is in accordance with the relevant policies of the Isle of Man Strategic Plan.

### The Site

2. The application site is the curtilage of Sarpedon, Orrisdale Road, Ballasalla which is a detached dormer bungalow situated to the southern side of the highway. There is a dormer window in both the front and the rear elevations; there are two existing roof lights in the rear elevation.

3. To the south eastern side of the application site is a neighbouring property "Gob Ny Geay", this property is approximately 17m from the side elevation, this property is set back further from the highway than the application site. There are some existing mature trees on the shared boundary between the application site and the neighbouring property.

### The Proposal

4. The application seeks retrospective approval for one roof light in the rear elevation.

5. Also proposed is the installation of two roof lights in the rear elevation and one in the hipped roof on the side elevation.

6. The two rooflights adjacent to each other would measure approximately  these would replace an existing window measuring . The other rooflight in the rear roof slope would measure approximately , which would replace a rooflight measure approximately .

7. The proposed roof light in the side roof slope would measure approximately .

8. There was a previous application in 2010 for the installation of a solar panel, this application was approved.

## Development Plan Policies

9. The application site is in an area zoned as "Area of High Landscape or Coastal Value and Scenic Significance" identified on the 1982 Development Plan. It is appropriate to consider Environment Policy 2 of the Isle of Man Strategic Plan (20th June 2007).

10. Environment Policy 2

The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance (AHLV's) as shown on the 1982 Development Plan and subsequent Local and Area Plans will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein. Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that:

a) The development would not harm the character and quality of the landscape; or b) The location for the development is essential.

11. Malew Commissioners do not object

## Assessment

12. There are two existing roof lights in the rear elevation which do not benefit from planning permission, they were installed approximately 3 and a half years ago.

13. This application seeks permission to install a roof light in the side roof slope and three roof lights in the rear roof slope which would replace the two existing.

14. The proposed roof lights would not look directly towards the neighbouring property and the neighbouring property "Gob Ny Geay" is at a sufficient distance so therefore would not result in undue overlooking or loss of privacy.

15. The proposed development would not the quality of the landscape and therefore would not adversely affect the character and appearance of the surrounding area.

16. For the above reasons the application is considered to be acceptable and is recommended for approval.

## Party Status

17. The local authority, Malew Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the installation of roof lights as shown in drawings Location Plan, Proposed Elevations and Photographs received 17th July 2012.
