### Officer's Report

#### Introduction

1. This application seeks permission for the installation of replacement windows to the front of a property in the Castletown Conservation Area. The application is considered to be acceptable and is in accordance with the relevant policies of the Isle of Man Strategic.

#### The Site

2. The application site is the curtilage of 105 Malew Street, Castletown which is a two storey mid terrace property. The dwelling is a new build property.

#### The Proposal

3. The application seeks approval for the installation of replacement windows in the ground floor. The windows were top opening casements with face applied Georgian glazing bars. The windows would be uPVC.

#### Planning History

4. The previous planning applications are not considered specifically material in the assessment of the current application.

#### Development Plan Policies

5. The application site is in an area zoned as "Predominantly Residential" identified on the Castletown Local Plan 1990. It is also in the Castletown Conservation Area. It is appropriate to consider Planning Circular 1/98 and Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).

If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare must have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same pattern and section of glazing bars and the same frame sections as the original windows.

Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.

7. Environment Policy 35

Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.

### Consultations

8. Castletown Commissioners have no objections.

### Assessment

9. The existing windows are uPVC casements with glazing Georgian bars, these windows are top outward opening casements. This method of opening is not original to the majority of properties in the Castletown Conservation Area. Many of the properties have sliding sash windows.

10. The proposed windows would have the same method of opening as the existing as well as similar glazing bars and sections.

11. The proposed replacement windows would preserve the existing method of opening and the glazing bars and sections. Given that the proposed replacement windows would preserve the character and appearance of the property and Conservation Area it is considered that the proposal complies with Environment Policy 35.

12. For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

13. The local authority, Castletown Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
