## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) Order 2005

On 15th November 2012, and in pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to **APPROVE** planning application **12/00889/B** by Department Of Education And Children for the installation of street lighting to south driveway at The University Centre The Nunnery Old Castletown Road Douglas Isle Of Man IM2 1QB subject to compliance with the following conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval for the installation of street lighting relates to Drawing No: 01 Rev No: C and 4 x A4 information sheet detailing lamp post specifications all date stamped 8th October 2012.

3. Prior to the commencement of works on the installation of the proposed lamp posts the trees identified sitting adjacent to the proposed lamp posts must be adequately fenced off and protected from damage during installation. Such fencing must be erected so as to protect the roots (generally directly underneath the drip line of the branches) and once erected, no material or vehicles may be stored or parked within the protected area.

4. The approved lighting may not be illuminated after 2300hrs or before 0700hrs in any day.

5. Notwithstanding the details on the submitted drawing, Drawing No: 01, the approval hereby granted applies only to lampposts labelled 1, 2 and 3.

NOTE: the Planning Authority is concerned that the remaining lampposts could have an adverse impact on bat habitat and as it has not been possible for a bat survey to be carried out, no approval can be granted to these lights. Any further application for further lighting must include a bat survey to indicate whether bats are present on the site and whether the site is used by bats for feeding or foraging.

## Guidance Note

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
