## Officer's Report

### The Site

1. The site is the curtilage of Cringle Quarry, Ronague, Castletown which is located on the western side of the A27, south of the Round Table and west of the Cringle Plantation.
2. Currently the frontage of the site is made up of 1.8 metre high temporary fencing within which the entrance gates are made up of field gates. Within the quarry there are four temporary buildings (portakabins/shipping containers) which make up a store, office generator room and a canteen. A weighbridge has also been erected at the entrance of the site and a number of machines associated with the workings of minerals (JCB wagons, vans etc) can also be found.

### The Proposal

3. The application seeks approval for Re positioning of personnel door to approved store building (PA 12/00005/B). The previously approved scheme proposed a personnel door within the large gable end door which also served as a vehicular access. This submission now proposes a separate pedestrian doorway alongside the larger vehicular door, to the southwest elevation of the building.

### Land Use Zoning / Planning Policies

7. The site has been zoned under the Isle of Man Development Plan Order 1982 as being within an area of 'surface mineral working'; the site is not within a Conservation Area, but is within an area zoned as High Landscape Value or Coastal Value and Scenic Significance.
8. Under the Modified Draft Area Plan for the South written statement the site is identified as being a mineral site (quarry) but this is not identified on the area plans.
9. Due to the zoning of the site the following Strategic Plan policies are relevant for consideration:-

Environment Policy 2: "The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance (AHLV's) as shown on the 1982 Development Plan and subsequent Local and Area Plans will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein.

Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that:

- (a) the development would not harm the character and quality of the landscape; or
- (b) the location for the development is essential."

10. General Policy 2: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;
- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption."

### Planning History

11. The following planning applications are considered relevant in the assessment and determination of this application:-

Erection of a building for maintenance and repair of vehicles and equipment, storage, staff facilities and offices, to replace existing buildings – PA 12/00005 - APPROVED

### Representations

12. Arbory Parish Commissioners indicate that they have no comments.

13. The Planning Authority has received no other privately written representations objecting to the proposal.

### Assessment

14. The proposal is a very modest alteration to the previous approval. As the proposal is to the south west elevation (i.e. to the rear of the building) the proposed alteration will not be apparent from the adjacent public highway and therefore will have no visual impact upon the area.

### Recommendation

15. Overall, the proposal would comply with relevant policies as stated within the Isle of Man Strategic Plan for the reasons given and therefore it is recommended that the application be approved.

### Party Status

16. The local authority, Arbory Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

17. The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

**C 1.**
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

**C 2.**
This approval relates to re positioning of personnel door to approved store building (PA 12/00005/B) as proposed in the submitted documents and drawings 4360/L1A, 4360/S2, 4360/S1 and 4360/P1 D all received on 18th April 2012.

**C 3.**
Within one month of the occupation of the approved building all existing buildings (store, office, generator room and canteen) shown on the approved plans as being removed, are to be removed from site.

C 4.

For the avoidance of doubt no commercial maintenance of vehicles/equipment is to be carried out at this site. This approved building may only be used to serve the needs of the company's vehicles/equipment associated with the quarrying operation.

C 5.

The elevational finishes of the building must be finished (cladding) and painted (render walls) in a natural grey/grey colour, whilst the roof finish must be a natural grey colour.

I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
