## Officer's Report

### Introduction

1. This application seeks permission for the installation of replacement windows in the front elevation in a mid terrace property. The application is considered to be acceptable and is in accordance with the relevant policies of the Isle of Man Strategic Plan.

### The Site

2. The application site is the curtilage of 78A Malew Street, Castletown which is a mid terrace property which is situated to the eastern side of the highway. The application site is a typical mid terrace dwelling. The application site is in the Castletown Conservation Area.

### The Proposal

3. The application seeks approval for the installation of replacement windows. The existing windows are top opening casements, the replacement windows would be white uPVC sliding sash.

### Planning History

4. There are no previous planning applications which are specifically material in the assessment of the current application.

### Development Plan Policies

5. The application site is in an area zoned as "Predominantly Residential" identified on the Castletown Local Plan 1990. It is also in the Castletown Conservation Area. It is appropriate to consider Planning Circular 1/98 in the assessment of the application.

If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare must have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same pattern and section of glazing bars and the same frame sections as the original windows.

Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.

### Assessment

9. The proposed windows would be constructed of u PVC and would have sliding sash openings. The windows would have the original method of opening and frame sections.

10. The proposed development is considered to enhance the character and appearance of the property and the Conservation Area in general.

11. For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

12. The local authority, Castletown Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
