### Officer's Report

#### The Application Site

1. The application site is the curtilage of an end-of-terrace retail unit in Hailwood Court off Hailwood Avenue, Douglas. The property has two storeys and a pitched slate roof. The walls are smooth render finished and painted a cream colour. Two windows are present at first floor level and a shop front at ground floor level. The front elevation overlooks a communal car parking area that serves the adjoining bookmakers, food takeaway, supermarket, public house and children’s nursery.

#### The Proposal

2. Proposed is the erection of replacement advertising signage between ground floor and first floor level on the front elevation of the property. The signage will read ‘Lloyds pharmacy’ with its logo. The sign will be 4055mm in width across the front elevation, 600mm in height, and protrude 100mm outwards from the front elevation wall. It will be made from turquoise colour Aluminium with the outline of the letters illuminated by fluorescent tubes.

#### Planning History

3. The application site, and a neighbouring site, have been the subject of a number of previous planning applications, two of which is considered specifically material to the assessment of this current planning application:

08/01705/D - Erection of advertising signage, 6 Hailwood Court – Approved.

04/02017/D - Erection of advertising sign on front elevation, 3 Hailwood Court – Approved.

#### Planning Policy

4. The application site falls within an area designated for Predominantly Residential use in the Douglas (North) Local Plan. There are no policies that accompanies the local plan, which are considered specifically material to the assessment of the planning application.

5. The Isle of Man Strategic Plan 2007 contains three policies that are considered specifically material to the assessment of this current planning application. General Policy 2 states:

"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (g) does not affect adversely the amenity of local residents or the character of the locality".

General Policy 6 states:

"Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:

- (a) are of a high standard of design and materials and relate well to the building and site on which they are to be displayed;
- (b) are in keeping with and do not detract from the surrounding area; and
- (c) are located so as not to cause a highway safety hazard".

General Policy 7 states:

"Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they relate will not generally be permitted".

### Representations

6. Douglas Borough Council has no objection to the proposal.
7. The Highways Division recommends that the application is approved as it has no adverse traffic management, parking or road safety implications.

### Assessment

8. The proposed signage relates to the use of the application property and is of a design that is sympathetic to the character and appearance of the application property. The illumination element of the proposal would not be adverse to the immediate surrounding area given the existing surrounding uses and illuminated signage. Furthermore, the scale of the proposed signage is considered to be proportionate to the size of the front elevation and is in-keeping with the scale of existing signage on the adjoining parade of retail units. The signage does not protrude outwards sufficiently from the elevation wall to adversely affect the function of the nearby car parking area, which is a view shared by the Highways Division.
9. Overall, the level of development is modest, relates to the application property, and is in keeping with the application property and surrounding area. Subsequently, the proposal complies with the provisions of General Policy 2, 6 and 7 in the Isle of Man Strategic Plan 2007.

## Recommendation

10. It is recommended that the planning application be approved.

## Party Status

11. It is considered that the following parties that made representations to the planning application should be afforded interested party status:

The local authority, Douglas Borough Council are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered "interested persons" and as such should be afforded party status.

12. It is considered that the following parties that made representations to the planning application should not be afforded interested party status:

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the erection of illuminated signage on front elevation of retail unit shown in drawing no. 1:1000 scale Location Plan 1:200 scale Site Plan, 3-D cross-sectional drawing, and proposal drawing 98448/A, all received on 2 April 2012.

I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
