In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:

### Reason(S) For Refusal:

1. It is considered that the justification for agricultural buildings, hardcore yard surface and track, as proposed on this site, has not been adequately proven. Furthermore the isolated position would result in built development encroaching into the open countryside to the detriment of the visual amities of the countryside. Consequently the proposal would be contrary to General Policy 3 and Environmental Policy 1, 2 & 15 of the Isle of Man Strategic Plan which all seek to protect the countryside from inappropriate development.

2. The formation of the track from the existing entrance results in an incongruous feature in the countryside within an Area of High Landscape or Coastal Value and Scenic Significance. Accordingly, given the development harms the character and quality of the landscape and is not essential, the creation of the track is contrary to General Policy 3 and Environmental Policy 1 and 2 of the Isle of Man Strategic Plan.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
