## The Town And Country Planning Act 1999

## The Town And Country Planning (Development Procedure) Order 2005

In pursuance of his powers under the above Act and Order, the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by Isle of Man Development Company – Approval in principle to demolish existing unit and erection of retail units with ancillary car-parking and servicing, Unit 6, Spring Valley Industrial Estate, Braddan, subject to compliance with the following conditions:-

1. Approval of the details of design, external appearance, of the buildings, internal layout, landscaping of the site (hereinafter called “reserved matters” shall be obtained from the Planning Authority in writing before any development is commenced.
2. The application for the approval of reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this permission.
3. The development to which this permission relates shall begin within 4 years of the date of this permission or within two years of the final approval of the reserved matters, whichever is the latter.
4. Details of the access and parking to be submitted pursuant to the reserved matters application shall include the number, location and layout of vehicle parking spaces, including access aisles, surface markings and manoeuvring areas, plus provision for pedestrians and cyclists.
5. There shall be no display or storage of goods outside the approved buildings.
6. This permission provides for a maximum retail floorspace of 1672m².
7. The permission shall provide for a maximum of 2 units and there shall be no further sub-division.
8. The development shall not be brought into use until the access and any junction improvements approved by the reserved matters application have been fully constructed.

9. Notwithstanding the provisions of article 4 of the Town and Country Planning (Permitted Development) Order 2005, or any order revoking and re-enacting that Order with or without modifications, the goods to be sold within the units hereby approved shall not include food and shall consist primarily of building, decorating and home-improvement materials and equipment, furniture and floor coverings, garden goods and equipment, car parts, spares, maintenance goods and equipment, camping equipment, boats, quad bikes, bicycles, electrical goods and equipment, light fittings, pet food, pet supplies and pets.
