I refer to the recent appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.

The Minister has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Planning Committee’s decision to approve the application should be confirmed subject to the amended conditions shown in the Formal Notice, a copy of which is attached.

### The Town And Country Planning (Development Procedure) Order 2005

In pursuance of his powers under the above Act and Order, the **MINISTER** for Infrastructure, following report by the appointed person, does hereby **APPROVE** the application by Mrs Margaret Halsall **Erection of a pair of apartments with garaging to replace two demolished dwellings - Plot formerly 1 and 2 The Promenade, Port St Mary** subject to compliance with the following conditions:-

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This approval relates to the erection of a pair of apartments with garaging to replace two demolished properties as proposed in the submitted documents and drawings AT 7873.1 and AT 773.2 received on 6th December 2011.
3. The proposed garaging must be completed for the parking of motor vehicles in association with the occupation of the proposed apartments prior to the occupation of the apartments and thereafter retained for such a use.
4. No development shall commence until details of vehicular/pedestrian access to be provided on site have been submitted to and approved in writing by the Planning & Building Control Division. The agreed access, including the provision of a drop kerb, shall be constructed and completed to the satisfaction of the Department of Infrastructure and made available prior to the first use or occupation of any building as part of the development hereby permitted and shall thereafter be retained in the agreed form.
